Payout set-to over Pocklington pothole - 06/09/2007An East Riding pot hole is leading a series of motorists to demand compensation from their local council.
The pothole in Pocklington caused driver Richard Duggan £823 damage to his car, while Craig Thorley faced a £1,500 repair bill when his BMW was damaged by the same poor surface.
Mr Thorley told the Pocklington Post: "It was like hitting a concrete block. I instantly had two flat tyres. The next morning they took the tyres off and both wheel rims were beyond repair."
Meanwhile, Mr Duggan explained that he was pursuing East Riding Council for compensation.
"They are not taking responsibility for it but are blaming the drivers.
"I don't know what leg they have got to stand on. They say they don't have any liability, which I don't understand. It also turns out they knew about the hole for a month before I hit it."
However, a council spokesman told the Pocklington Post that it would be paying out compensation.
"As the highway authority, East Riding of Yorkshire Council has a duty to ensure that, as far as is reasonably possible, its highways are safe to use," he said.
"We have in place a rigorous inspection regime to achieve this. As the council has complied with the obligations placed on it by law, it will not be paying compensation to the claimant in this case."
