Brain Damage

Severe brain damage £155,000 - £220,000

This would fall under someone having some ability of following basic movement or commands, the recovery of eye opening and retuning of sleep and waking patterns. There will be little or no response to surrounding environment, language function and the need for a full time nurse to take care of them.

The amount of compensation rewarded would fall into the following categories:

• The degree of insight
• Life expectancy
• The extent of physical limitations

You would only be compensated the top end of the compensation where there is a significant effect on the senses and severely physically limited.

If the claimant is in a vegetative state or death occurs very soon after the injury but was not aware of the injury and what caused it then the compensation would only be for the loss which would be substantially below the compensation bracket stated above.

Moderate Brain Injury

This is marked by the degree of dependency being marked lower than severe brain damage.

£82,000 - £120,000

If your sight, speech and senses are effected then you would fall into the bracket along with a significant risk of epilepsy. If there was a chance of you never being able to work again (becoming employed) then the sum of compensation would be between the amount above.

£50,000 - £82,000

This is in cases where there is moderate intellectual deficit, the chances of working again are reduced or a risk of epilepsy then you may be eligible to receive the amount stated above.

£23,500 - £50,000

This would be where memory is effected, again the ability of working is reduced and where there would be a slight chance of developing epilepsy from the accident. The dependence upon others would be very limited.

Minor Brain Damage

£8,500 - £23,500

This would be when the injured person would make a good recovery from the accident and is able to carry out the rest of their lives normally. Returning to work and carrying out their duties would not be a problem. There may not be a full recovery as they may still suffer from small symptoms but none of which would interrupt everyday activities. If they do suffer from poor concentration which would effect them in future activities then they would be eligible to receive the top end of the compensation stated above.

The level of compensation rewarded falls into the following brackets:

• The extent of the initial injury
• Possibility of the injury continuing or even turning permanent, this would then make them disabled
• Depression

Minor Head Injury

£1,250 - £7,000

For a person to have minor head injuries, brain damage would be minimal or non-existent.

The level of compensation rewarded would be considered by the following:

• Severity of the injury sustained
• The period taken to recover
• The extent of the continuing injuries or symptoms that may have developed from the initial injury
• The extent of the continuing symptoms
• The presence of headaches

If a full recovery is made after a month then you may be rewarded with the minimum amount of compensation listed above.
