Law firm recovers £550’000 for injured labourer - 08/04/2008

Field Fisher Waterhouse, the European law firm, has succeeded in winning a £550’000 work accident claim for a labourer who was seriously injured by a mechanical digger.

The Romanian received the payout for the December 2005 accident when the digger drove a blade into both of his legs. His left leg needed to be amputated below the knee and he now requires a prosthetic limb to walk.

Legal proceedings to recover compensation for the labourer commenced in December 2005 but were held up due to wrangling between the defendant and its insurance provider. During the delay, Field Fisher Waterhouse obtained interim payments to assist their client with medical treatment.

A trial was eventually scheduled for December 2007 and after further talks, a compensation deal worth £550’000 was settled out of court. Field Fisher Waterhouse took the case on a ‘no win no fee’ basis and the injured man has received full damages.

“I am happy that we were able to recover this compensation for our client, who was injured through no fault of his own whilst at work,” said Paul McNeil of Field Fisher Waterhouse.
