No win no fee lawyers charging double - 09/04/2008The Conditional Fee Agreement is at the centre of a debate, as 22 organizations have grouped together to lobby the government to make some big changes. The Conditional Fee Agreement means that lawyers are able to bring libel claims against media groups, using a no win no fee approach. This means that people who would not have been able to sue now have an opportunity to do so. However, there is an additional piece to the agreement which is known as the “success fee”. The success fee is charged if the complainant wins, and is in addition to any costs the claimant may have occurred. This has resulted in some solicitors charging up to double their normal fees.
Originally the success fee was put in place to compensate the lawyers if they lost some of their cases. Getting paid more when they won would effectively tide them over when they lost. However the rising costs of these no win no fee cases has led to the march to government, to see whether this system really is as fair as it could be.
