Changes need to personal injury claims system - 09/04/2008An expert insurance group is calling for change within the personal injury claims system.
The Association of British Insurers (ABI) has said that government proposed changes could reduce the time taken for a claim to be processed by 75 per cent.
At present the ABI estimate that an average work accident claim lasts up to three years and a car accident related claims up to two years.
The ABI would like to see lawyers that are involved in claiming compensation to contact the insurance firm concerned in a timelier manner.
Currently solicitors research evidence first then contact the insurer to notify them of the claim. This can lengthen the process. Likewise Insurance companies may not quickly reveal to the claimant's lawyer that they dispute liability.
"What tends to happen is that a person who has been injured goes to a lawyer who does a vast amount of research, often unnecessarily in our opinion, before putting the claim anywhere near the insurer.
"There is then a process of negotiation over liability and settlement in a very adversarial system," said an ABI spokesperson.
